Maui County Council passed Bill 88, creating two new hotel zoning classifications that could allow certain condos facing a short-term rental ban to continue operating as vacation rentals. Any rezoning still requires planning commission review and a Council vote.
- The Council voted 7-2 on June 19 to create new hotel zoning categories that up to ~4,500 ‘Minatoya List’ condos could pursue to avoid the STR ban established by Bill 9.
- Bill 9 bans short-term rentals in affected apartment-zoned condos starting Jan. 1, 2029 in West Maui and Jan. 1, 2031 in South Maui.
- Bill 88 does not automatically rezone any properties — each project must go through planning commission review and a separate Council decision.
- Mayor Bissen supported Bill 88 as a structured exemption pathway for properties originally built and intended for visitor accommodation use.
- All affected properties were approved before 1989, when Maui County stopped allowing vacation condos in apartment zoning districts.
